Terms and Conditions of Sale
The following are terms and conditions for the sale of goods that will govern
any contract for sale that we enter into with you. Please read these terms and
conditions carefully.
An order for goods will be deemed as an offer by you to purchase the goods
subject to these terms and conditions.
To order goods from the Optical Mail Order website you must be at least 18 years of
age. If ordering spectacles or other items that are subject to optical
prescription measurements, we are unable to supply such items if you
are registered blind or partially blind or your prescription is over
two years old or you are ordering on behalf of someone who is under 18
years old.
When ordering, you must provide us with details of
the relevant prescription that is to be applied to the goods. All
prescriptions provided to us must have been given to you by a
Registered Medical Practitioner or Registered Ophthalmic Optician
following an eye examination by them within the last 2 years.
We will rely upon the prescription details that
provide to us and the goods provided will contain lenses matching
those prescription details submitted.
If you are unsure of the relevant prescription
details to be applied to the goods, please consult a Registered
Medical Practitioner or Registered Ophthalmic Optician before placing
an order.
Unless you provide us with the measurement, we use
an appropriate average Pupillary Distance 'PD' to complete your order.
This PD measurement has been provided by fully qualified Dispensing
Opticians. By agreeing to these terms and conditions, and unless you
state otherwise, you will be agreeing to let us use an average PD.
It is strongly recommend that you consult your Optician to obtain your
PD before ordering, and provide that measurement to us when ordering.
We will endeavour to ensure that all ordered items will be
dispatched within ten
working days of your credit card order. Your order will be confirmed by e-mail.
Orders paid by cheque will be dispatched within ten working days from when the cheque
has been cleared.
Whilst we will endeavour to deliver goods within the times stated,
al goods are subject
to availability, therefore delay in the delivery of goods is sometimes outside of our
control.
Any dates we specify for the delivery of the goods are approximate only and we shall
not be liable for any losses, costs, damages, charges or expenses caused by any
delay for delivery of the goods unless caused by our negligence.
On rare occasions, should our suppliers be unable to meet our requirements, we may
find it impossible to fulfill your order. If such an occasion should occur we will
inform you immediately by e-mail. Should we be unable to supply any item of your order
we will give you the choice of either canceling the whole order or receiving the
remainder of the order. We will not split delivery of any order.
Either of us shall have the right to terminate any contract between us without
penalty within 14 days from the date we receive your order. In the event of
termination we shall refund to you all sums paid by you to us and you shall return
any goods that we have dispatched to you.
We will replace any goods which aren't suitable or are faulty or damaged. We will not
be held responsible for compensating you for any other losses which you may suffer
if we do not supply goods.
Contact us by phone or e-mail with full details of any problems regarding any order made
by you on Optical Mail Order Ltd. All contact with us in such matters will be
acknowledged via e-mail.
Returned goods must be unused and in a saleable condition. Once we've received them
back, we will arrange to either credit you or replace the goods, whichever you prefer.
All return packaging and postage costs must be met by you, will will
not refund such costs unless the reason for returning items is due to
our negligence.
As soon as we have delivered the goods you will be responsible for them. If you delay
accepting a delivery, our responsibility for everything other than damage due to our
negligence will end on the date the carrier tried to deliver the goods to you.
IMPORTANT NOTICE: time limit for notification of claims. If goods arrive in a damaged
condition you must inform us within 7 days. We will arrange collection of these goods
and we will replace the goods at no charge or refund any money paid for the goods.
IF YOU DO NOT DO THIS WE SHALL HAVE NO LIABILITY FOR GOODS SAID TO BE DAMAGED ON DELIVERY.
All goods sold by Optical Mail Order Ltd. carry a normal manufacturers
warranty.
The price for the goods will be as stipulated at the time when you place your order.
We retain the right to make adjustments to the price to take account of any increase
in our supplier's prices, or the imposition of any new taxes or duties, or if due to
an error or omission the price published for the goods on our website is wrong.
We will inform you of the correct price and give you an opportunity to cancel the
order. If the goods have already been delivered, we will give you an opportunity to
return the goods and receive a full refund of the price and any delivery charges you
have paid for the goods.
You will only own the goods once we have received payment in full.
We do not offer any credit facilities. We will issue you with an electronic invoice
once we have received payment in full for your order and once we have dispatched the
goods to you.
Reglazing customer supplied frames - whereas every care and attention is made when reglazing
customer supplied frames. All frames supplied are glazed at the customers own risk, we cannot accept any responsibility
for breakages or distortions of supplied frames during the reglazing process.
We will supply goods that are free from defects in materials and workmanship for a
period of 12 months (or longer if required by law) from the date of delivery. This
does not affect any other statutory rights that you may have.
Our 30 day guarantee period begins from date of
order of goods. The guarantee means that if you are not happy with
your glasses, for any reason, please return them to Optical Mail Order
Ltd. 42a Elm Grove, Hayling Island, Hants, PO11 9EF, United
Kingdom, and we will replace them free of charge. Items must be sent
to us using Royal Mail registered post - where a tracking number
is provided. If you wish to return your glasses for a refund you
will need to return the glasses, with the case and cloth in good
order. Upon receipt of the package we will refund an amount for the
whole package only. All returns must be sent using Royal Mail
Recorded Delivery or Royal Mail Special Delivery as we cannot be held
responsible for returned goods that are lost or damaged in transit.
Unfortunately the cost of carriage and insurance is
non-refundable.
The Contract between us shall be governed by the laws of England and Wales and any
dispute will be resolved exclusively in the courts of England and Wales. We operate
a complaints handling procedure which we will use to try to resolve disputes when

These terms and conditions are subject to change at any time without prior notice to
